Na de aankondiging van een nieuwe laptop is er nu juist slecht nieuws voor een ander bedrijf dat onder licentie Nokia-producten produceert. Dankzij een rechtszaak tegen HMD Global mogen smartphones uit de G-, X- en C-series niet verkocht worden in Duitsland, en waarschijnlijk op de gehele EU-markt. HMD is in beroep gegaan tegen de uitspraak van de Duitse rechter, maar tot de uitspraak mogen de telefoons niet verkocht worden.

De zaak is aangespannen door een bedrijf met de naam VoiceAgeEVS LLC en gaat over Enhanced Voice Services, een Voice over LTE-protocol dat zonder toestemming gebruikt wordt. Het bedrijf is houder van een patentenportfolio gerelateerd aan stem- en audiotechnologie voor onder andere smartphones. Eerder werden schikkingen getroffen met fabrikanten zoals Apple, Lenovo en TCL, eveneens over het gebruik van EVS zonder licentie.
Statement HMD Global
HMD is a defendant in several lawsuits initiated by a patent troll called VoiceAgeEVS LLC ("VAEVS") in different jurisdictions, including Germany. Landgericht Mannheim has given its first ruling in these lawsuits as a court of first instance that the patent-in-suit is considered infringed by said court. There is no decision yet on the validity of said patent, given that the invalidity proceedings are pending before a different German court. HMD is disappointed in the decision of the court of first instance and has appealed. HMD remains confident regarding the outcome of the overall dispute.
As the owner of significant patent portfolio itself, HMD takes intellectual property rights seriously and is willing to offer and take licenses on fair, reasonable and non-discriminatory (“FRAND”) terms. Given the excessive non-FRAND royalty demands made publicly by VAEVS, HMD has already taken measures to remove support for EVS from products sold in Germany thereby enabling the continued sales in Germany. Given the marginal (if any) benefits with EVS and how rarely it is supported by the operators, HMD does not expect the removal of EVS functionality to have any meaningful impact on its business.
